• Rights and Liberties Protection Act A BILL To enhance the exercise of Second Amendment rights by law-abiding citizens through a voluntary Proof of Background Check (PBC) system, implement privacy-focused background check alternatives, and ensure accountability for violations of constitutional rights, and for other purposes. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the “Rights and Liberties Protection Act.” SECTION 2. FINDINGS AND PURPOSE. (a) Findings. Congress finds that— 1. The Second Amendment, as interpreted by the Supreme Court in District of Columbia v. Heller (2008) and McDonald v. Chicago (2010), protects an individual right to keep and bear arms for self-defense, applicable to both federal and state governments. 2. Law-abiding citizens should not face undue burdens in exercising their constitutional rights, including inconsistent state regulations or privacy-invasive background check systems. 3. The National Instant Criminal Background Check System (NICS) has effectively prevented prohibited persons from acquiring firearms but raises concerns about centralized data retention and potential misuse. 4. A voluntary certification system, coupled with privacy-preserving alternatives, can affirm eligibility to exercise Second Amendment rights while supporting public safety. 5. Accountability for intentional violations of constitutional rights by government officials should be balanced with due process and respect for legislative discretion. (b) Purpose. The purpose of this Act is to— 1. Establish an optional Proof of Background Check (PBC) system to facilitate the lawful carrying of firearms across state lines. 2. Authorize Unilateral Background Checks and a Blind Identification System (BIDS) as alternatives to NICS, prioritizing privacy and efficiency.
