While Olivia was at school, her parents got into a 30-minute argument that ended with her mom being shot. A recording ABC13 got a hold of shows them arguing heatedly, with her dad saying he’s “done” and her mom responding the same way.
Birmingham’s lawyer, Anthony Osso, said they admitted guilt to the jury, made up of all women, to show that he acted in the spur of the moment when he shot his wife, Patricia. Osso explained that their defense was about understanding why Birmingham did what he did, not excusing it.
Birmingham is sentenced to 10 years in jail for this crime but could be released on parole in five years.
Olivia feels like she lost both her parents that day. She said her dad changed completely when he killed her mom. She believes people don’t just suddenly act on passion; it takes time to decide to hurt someone they love.
In court, Olivia told her dad that no matter what was said during the trial, he knows the truth about what he did and the kind of person her mom was. She also said she had never seen her dad hurt her mom before.
Olivia wants to spread the word about the different ways abuse can happen, and she said she can never forgive her dad for what he did.
Patricia’s sister, Mary Dees, posted online that her sister was brave and never showed fear. She praised the prosecutors and noted that even the judge seemed surprised by the outcome, feeling that justice wasn’t served and her sister didn’t deserve what happened. Mary stressed that Birmingham is not the victim in this case.
He is eligible for parole in just 5 years.

Yea not shit. Crime of passion. She wasn’t completely innocent and definitely wasn’t trying to calm him down. She instigated it from start to finish. The guy went his whole life without hurting anyone and in this moment of confusion acted out of character. Sentence is about right.
